A. Introduction

These Terms and Conditions govern the relationship between Keys to Algarve, a registered brand of Energia7, Unipessoal, Lda (“Keys to Algarve”, “the Company”, “we”, or “us”) and any individual or entity making a reservation or staying at one of our managed properties (“the Client” or “Guest”).

By confirming a reservation or using our services, the Client acknowledges that they have read, understood, and agreed to be bound by these Terms and Conditions.

If the Client does not agree with any of the conditions herein, they must refrain from using our services or website.

B. Booking and Payment

1. A booking is only valid once confirmed in writing (via email) by Keys to Algarve.
2. A deposit of 30% of the total booking amount must be paid by bank transfer within 72 hours of confirmation. The booking will be cancelled automatically if payment is not received within this period.
3. The remaining balance must be paid prior to check-in or as specified in the booking confirmation.
4. Proof of payment must be sent to: info@keystoalgarve.com.
5. All prices include VAT unless otherwise stated.
6. Keys to Algarve makes every reasonable effort to ensure that all prices, property descriptions, and availability displayed are accurate. However, we reserve the right to correct any typographical, technical, or human errors that may result in manifestly incorrect prices or inaccurate information.
7. If a booking has been made based on an obvious pricing or availability error, Keys to Algarve reserves the right to cancel the reservation and refund any amounts already paid, without any obligation to provide additional compensation.

C. Cancellations and Refunds

1. Cancellations made more than 30 days before check-in: The Client is entitled to a full refund of the deposit, excluding any transaction fees. Alternatively, the deposit may be applied to a future booking.
2. Cancellations made within 30 days of check-in: No refund will be issued. The deposit may be applied to a future stay at the discretion of Keys to Algarve.
3. Cancellations on or after the check-in date: The Client is liable for the full amount of the booking.
4. Bookings made through third-party platforms (e.g., Airbnb, Booking.com) are subject to the cancellation and refund policies of those platforms.
5. If the booked property becomes unavailable due to circumstances beyond the reasonable control of Keys to Algarve (including unforeseen damage, major technical failures, or situations affecting the safety or habitability of the property), Keys to Algarve may offer alternative accommodation of an equivalent or higher standard or, if this is not possible, provide a full refund of all amounts paid. No additional compensation shall be due.

D. Check-in and Check-out

1. Check-in and check-out times are indicated in the property listing.
2. Late check-in fees apply as follows:
   1. €20 for arrivals between 20:00 and 00:00
   2. €40 for arrivals after 00:00
3. Unauthorized late check-outs will incur a €50 fee.
4. The Client must inform Keys to Algarve of their estimated arrival and departure times at least 1 hour before check-in and 12 hours before check-out.
5. During peak periods, delays of up to 60 minutes in check-in may occur; no compensation or refund will be issued.
6. One set of keys will be provided per booking. A second set can be provided with a refundable €15 deposit.
7. If the guest fails to arrive by 12:00 PM (midday) on the day following the scheduled check-in date and has not informed Keys to Algarve of any delay, the reservation may be considered cancelled, and all contractual payment obligations shall remain applicable.

E. Security Deposit

1. A refundable security deposit must be paid as stated on the booking details page or, if no specific date is provided, no later than 7 days before check-in.
2. The deposit will be refunded by bank transfer within 7 days after check-out, subject to inspection of the property.
3. The deposit will be partially or fully withheld in the following cases:
   1. Theft or damage to property, furnishings, or equipment;
   2. Acts of vandalism;
   3. Breach of the Terms and Conditions.
4. If damages exceed the deposit amount, the Client must pay the balance upon notification. Photographic evidence will be provided.
5. The inspection carried out after check-out does not prevent the subsequent identification of hidden damage or issues that are only discovered during cleaning, maintenance, or preparation of the property for future guests.
   In such cases, Keys to Algarve reserves the right to deduct the corresponding costs from the security deposit or claim the outstanding amount separately, providing reasonable supporting evidence.
6. If damages, losses, or breaches of these Terms and Conditions require further assessment, the security deposit refund period may be extended until the investigation has been completed. The guest will be informed accordingly.

F. Guest Responsibilities

1. The Client agrees to use the property solely for accommodation purposes and to maintain it in good condition.
2. Moving or removing furniture and large items from their original position is strictly prohibited.
3. Smoking inside the property is strictly prohibited. Any breach of this rule may result in additional charges for deodorising, deep cleaning, textile treatment, or any other work required to restore the property to its original condition.
4. The Client must respect public order and maintain quiet hours between 22:00 and 08:00. Violation of this rule may result in immediate termination of the stay without refund.
5. The number of guests must not exceed that specified in the booking confirmation.
   1. An additional fee will be charged for any extra guests beyond the number stated in the booking confirmation.
   2. If the legal occupancy limit is exceeded, Keys to Algarve reserves the right to terminate the stay without refund.
6. Only guests registered in the reservation or subsequently authorised by Keys to Algarve may remain at the property.
   Unauthorised visitors may result in additional charges or the immediate termination of the stay without any entitlement to a refund.
7. The Client must leave the property in a tidy condition, with no excessive dirt or waste.
8. If extraordinary cleaning is required due to excessive rubbish, stains, strong odours, food waste, cigarette residue, vomit, misuse of the property, or any condition exceeding normal turnover cleaning standards, Keys to Algarve reserves the right to charge the corresponding cleaning costs.
9. The use or possession of illegal substances is strictly prohibited.
10. Parties, events, commercial filming, gatherings, or any activity involving more people than the maximum authorised occupancy are strictly prohibited.

G. Long-Term Stays

1. For stays longer than 30 consecutive days, the cost of electricity and water consumption will be charged separately and must be settled according to the actual usage and rates applicable during the stay.

H. Pets

1. Guests must request written authorization (via email) to bring pets prior to arrival.
2. Acceptance of pets is subject to approval by Keys to Algarve and may incur additional cleaning fees or a higher security deposit.
3. Pets are not allowed in swimming pools, on beds, or on sofas.
4. Any damages caused by pets must be paid for immediately.
5. Unauthorized pets may result in immediate termination of the stay without refund.
   

I. Safety and Liability

1. Guests are fully responsible for ensuring that all windows and doors are locked when leaving the property.
2. Keys to Algarve is not liable for theft, loss, accidents, injury, illness, or death occurring during the stay.
3. Guests are advised to obtain their own travel and personal insurance.
4. Parents or guardians are responsible for supervising minors at all times.
5. If a safe is available, it can be used upon request and may incur an additional cost.
6. Internet access, television, streaming services, and any other technology-related amenities are provided as complimentary conveniences. Keys to Algarve does not guarantee their continuous availability, speed, or uninterrupted performance.
7. Keys to Algarve shall not be held liable for temporary interruptions to electricity, water, gas, internet, or any other public utility services where such interruptions are caused by external providers or circumstances beyond its reasonable control.
8. Items left behind after check-out will be stored for a maximum period of 30 days. Upon request, such items may be returned to the guest at the guest's expense and subject to operational availability.
9. Where a swimming pool is available, its use is entirely at the guests' own risk. Parents and legal guardians are solely responsible for supervising minors at all times. Keys to Algarve accepts no liability for accidents arising from improper use of the facilities or lack of supervision.

J. Extra Services

1. Keys to Algarve may provide extra services (e.g., cleaning, linen changes, transfers) upon request.
   Such services are available only by prior appointment between 09:00 and 19:00 and are subject to availability and additional charges.

K. Force Majeure

1. Keys to Algarve shall not be held responsible or liable for any failure or delay in performing its obligations due to circumstances beyond its reasonable control, including but not limited to: natural disasters, fires, floods, storms, pandemics, war, strikes, civil disturbances, governmental actions, or utility failures. In such cases, refunds or rescheduling will be handled at the sole discretion of Keys to Algarve.
2. Whenever reasonably possible, Keys to Algarve will seek to provide appropriate alternatives, including rescheduling the stay or refunding amounts relating to services not yet provided or unrecoverable costs, taking into account the specific circumstances of each case.
3. Keys to Algarve may access the property, with prior notice whenever reasonably possible, for inspections, urgent repairs, essential maintenance, compliance with legal obligations, or to protect the safety of persons and property. In cases of emergency, suspected unlawful activity, or serious breaches of these Terms and Conditions, access may take place without prior notice.

L. Data Protection (GDPR)

1. Keys to Algarve processes personal data in accordance with the General Data Protection Regulation (EU) 2016/679 (GDPR).
2. Client data is collected solely for reservation management, legal compliance, and communication purposes.
3. Personal data will not be shared with third parties, except where legally required or necessary to provide contracted services.
4. Personal data will be retained only for the period necessary to fulfil applicable legal and contractual obligations.
5. Data subjects have the right to access, rectify, erase, restrict processing, object to processing, request data portability, and lodge a complaint with the competent data protection authority.
6. Clients may request access, correction, or deletion of their data by contacting: info@keystoalgarve.com.

M. Governing Law and Jurisdiction

1. These Terms and Conditions shall be governed by and construed in accordance with Portuguese law.
   Any disputes arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the Tribunal de Silves, Portugal.
2. In the event of a consumer dispute, the consumer may resort to an Alternative Consumer Dispute Resolution (ADR) entity in accordance with applicable Portuguese law.

N. Final Provisions

1. Any matters not expressly covered in these Terms shall be resolved in accordance with Portuguese legislation.
2. In the event of any discrepancy between the property listing and these Terms and Conditions, the provision that is most specific to the reservation shall prevail, without prejudice to any mandatory provisions of applicable law.
3. The Client’s use of the property constitutes full acceptance of these Terms and Conditions.

1. All content on the Keys to Algarve website, including text, images, videos, and other media, is copyrighted and may not be reproduced, distributed, or used without prior written permission from Keys to Algarve.
